SHOW CAUSE NOTICE

 

 

That you, Shri. T. Premkumar, Assistant Professor, College of Forestry, Vellanikkara had been granted HPL for 119 days from 19.05.1994 to 14.09.1994, LWA for 120 days from 15.09.1994 to 12.01.1995 and study leave for 3 years from 13.01.1995 to 12.01.1998.  You have been granted LWA for 2 more years w.e.f. 13.01.1998 to 12.01.2000 under Rule 88, Part I, Kerala Service rules.  In the letter received on 13.01.2000 you have submitted that you have not completed the Ph.D course and have not able to join back in KAU.  You have requested to extend your joining time from13.01.2000, until the completion of the course.  Later you have submitted an application dated 03.07.2002 for LWA for the period from 13.01.2000 to 30.11.2002 on personal grounds which was not sanctioned by the University  Again you applied for LWA for employment abroad from 13.01.2000 to 12.01.2004 which was also not been granted.  It seems that you are evading from joining duty.  You are also under bonded obligation and you were repeatedly requested to clear the bonded obligation or report for duty.  Since you are on unauthorized absence w.e.f. 13.01.2000, disciplinary action was initiated and a memo of charges issued to you.  In your reply, you stated that you would like to avail voluntary retirement clearing the bonded obligation.  On verification of service records, it is seen that you have not completed 20 years service ie., minimum qualifying service for allowing voluntary retirement.  It is also found that a sum of Rs. 1,96,859/- is to be recovered from you to clear the bonded obligation and an amount of Rs. 74,365/- is due to you towards arrears.  As such a sum of Rs. 1,22,494/- (deducting a sum of Rs. 74,365/- from Rs.1,96,859/-) is due from you.  

 

As per University order dated 23.04.2008 an enquiry as per SRO 293/72 has been ordered.  The enquiry officer in his report has recommended to take appropriate action against you as per rules.  He has also requested to consider the request of you to reduce the liability against you to a reasonable extent.

 

On further scrutiny, it is found that a sum of Rs. 1,15,057/- is to be recovered from you to clear off the bonded obligation and that a sum of Rs. 1,52,505/- is available in your PF account as per credit card for 1999-2000.

 

The whole matter was placed before the Executive Committee of the University and the Executive Committee in its 466th meeting held on 22.02.2010 has decided the following:

 

(i)         Reject your application for voluntary retirement.

(ii)        Continue the disciplinary proceedings initiated against you.

(iii)       Award punishment as per rules.

(iv)       Adjust the outstanding liability of Rs. 1,15,057/- against the amount available in the PF account of you at the time of closure.

 

You are therefore requested to show cause within 30 days from the date of receipt of this notice as to why punishment as per Section 23 of SRO 293/72 should not be awarded to you.
